Terms and Conditions of Sale

1. Seller

The Ariette website (ariette.app) is published and operated by Chillax Capital, a [FORME JURIDIQUE] with share capital of [CAPITAL] €, registered with the RCS of [VILLE] under number [SIREN], whose registered office is located at [ADRESSE], intra-EU VAT number [NUMÉRO TVA]. Contact: contact@ariette.app.

2. Purpose

These terms govern the online sale of personalised songs generated by artificial intelligence (the "Content") to consumers. Placing an order implies their unreserved acceptance.

3. The Content

The customer fills in a questionnaire (recipient's first name, occasion, memories, music style, language). Based on this information, an artificial intelligence system writes lyrics, which the customer can edit before payment, then generates two sung versions of the song, a video with the lyrics and a shareable gift page.

The Content is entirely generated by artificial intelligence. It is neither composed nor performed by a human artist. Each generation is unique: the musical result (voice, melody, arrangement) cannot be predicted or guaranteed in advance.

4. Price

Prices are stated in euros including all taxes (or in the currency displayed according to the customer's country). The applicable price is the one displayed when the order is confirmed. Any options (additional version, etc.) are shown with their price before payment.

5. Order and payment

The order is concluded after the lyrics are approved, these terms are accepted and full payment is made by bank card or digital wallet, through Stripe Managed Payments. Payment is collected by Link (a Stripe group service), which acts as reseller and merchant of record for the transaction: it collects the applicable VAT or sales tax, issues the receipt and invoice, and appears on the bank statement as "LINK.COM* ARIETTE". Chillax Capital remains responsible for creating and delivering the Content. The customer receives an order confirmation by email.

6. Delivery

The Content is delivered electronically, usually within 5 minutes of payment, by an email containing the link to the gift page and the file downloads. If delivery is delayed by more than 24 hours, the customer may request a full refund.

7. Right of withdrawal

In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium, where performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal.

Before payment, the customer ticks a box by which they request immediate generation of the Content and acknowledge that they lose their right of withdrawal. This waiver is confirmed to them in the order confirmation email.

8. "Love it or we remake it" guarantee and refund

Independently of the statutory guarantees, the customer is entitled to:

  • one free regeneration of the song, with different lyrics or a different style, on request from their order page;
  • a full refund on simple request to contact@ariette.app within 7 days of delivery if the Content does not suit them, limited to one refund per customer.

9. Statutory guarantee of conformity

The Content benefits from the statutory guarantee of conformity for digital content provided for in Articles L224-25-12 et seq. of the French Consumer Code. In the event of a lack of conformity (unreadable file, content not matching the order), the customer may obtain that the Content be brought into conformity or, failing that, a price reduction or termination of the contract.

10. Prohibited content

The customer undertakes not to provide information that is hateful, defamatory, insulting, sexual, discriminatory, threatening or that infringes the rights of a third party, nor to request the imitation of a real artist or public figure. The system automatically refuses such requests; an order refused on these grounds is not charged or is refunded.

11. Licence of use

Chillax Capital grants the customer a non-exclusive, free, worldwide licence to use, reproduce and share the Content for personal and non-commercial purposes, including on social networks. Any commercial exploitation (advertising, distribution on streaming platforms, resale) is excluded without prior written agreement.

The customer warrants that they hold the rights to the information they provide and that they have the consent of the persons concerned where that information identifies them.

12. Liability

Chillax Capital cannot be held liable for the use made of the Content by the customer or the recipient, nor for the information provided by the customer. Chillax Capital's liability is limited to the amount of the order concerned, except in the case of gross negligence or wilful misconduct.

13. Personal data

The processing of data is described in the privacy policy.

14. Mediation and disputes

In the event of a dispute, the customer first sends a complaint to contact@ariette.app. If no amicable solution is found, they may refer the matter free of charge to the consumer mediator: [NOM ET COORDONNÉES DU MÉDIATEUR]. They may also use the European online dispute resolution platform.

These terms are governed by French law, without prejudice to the more protective mandatory provisions of the consumer's country of residence.
